These terms govern your use of the Calzone app and this website. By creating an account you accept them. If you do not, the app is not for you, and that is fine.
1. The agreement
This is a contract between you and us. It covers the Calzone mobile app on iOS and Android, this website, and the services behind them, together called the Service.
2. Who we are
Calzone is operated by Krzysztof Szyszka, a sole trader registered in Poland. Contact: support@calzone.fit.
3. Who can use Calzone
You must be at least 16 years old in the European Economic Area, or at least 13 and old enough under your local law elsewhere. Calzone is a general-audience app for adults and older teenagers, not a medical or clinical tool.
4. Your account
You need an account, because your logs are stored against it and synchronised between your devices. Keep your sign-in details to yourself, give us accurate information, and tell us at support@calzone.fit if you think someone else is in your account. We can suspend or close an account that breaks these terms or is being used to damage the Service or other users.
5. What Calzone is, and is not
Calzone estimates calories, macronutrients and micronutrients from photos, barcodes, menus and text. Estimates are estimates. A photo cannot show how much oil is in a pan, and a menu does not list grams. Treat the numbers as a well-informed guide, not a measurement.
Calzone is not a medical device and gives no medical, dietary or nutritional advice. Nothing in the app diagnoses, treats or prevents anything. If you are pregnant, have a medical condition, take medication, or are recovering from an eating disorder, talk to a qualified professional before changing how you eat. What you eat is your decision and your responsibility.
6. Subscriptions and payment
Calzone has a free tier and a paid tier, Calzone Premium, offered as a monthly or a yearly subscription. The current price, the length of each period and any introductory offer are shown in the app before you buy and are the prices that apply.
- Subscriptions are sold and billed by Apple through the App Store, or by Google through Google Play, depending on where you installed the app.
- They renew automatically at the end of each period unless you cancel at least 24 hours before it ends. Cancellation is done in your App Store or Google Play account settings, not by us.
- An introductory or free trial offer is limited to one per user, and is subject to the store's rules.
- Refunds are handled by Apple or Google under their policies. We can ask on your behalf but we cannot process a store refund ourselves.
- If we change the price of an existing subscription, you will be told in advance and asked to agree before it applies to you.
7. Right of withdrawal
As a consumer in the European Union you normally have 14 days to withdraw from a distance contract for digital content. When you start a subscription, you ask for it to begin immediately and you acknowledge that you lose that right once performance has begun, which is how the app stores work in practice. This does not affect your statutory rights if the Service is faulty, and it does not affect Apple's or Google's own refund policies, which are often more generous.
8. Acceptable use
You agree not to:
- Use the Service to break the law or to harm anyone.
- Reverse-engineer the app, scrape our data, or try to extract our prompts or keys.
- Submit content that is unlawful, abusive, or that infringes someone else's rights.
- Publish junk, spam or deliberately wrong nutrition values to the shared product catalogue.
- Automate requests, run the AI features in bulk, or work around usage limits.
- Resell or sublicense the Service without our written permission.
9. Your content
Your photos, entries and notes stay yours. You give us the permission we need to host and process them so the app can work, including sending a photo or description to our AI provider to produce an estimate. We do not sell your content.
The shared product catalogue is different, and worth understanding. When you publish a product to it, you allow every other Calzone user to find, use and build on that entry, and it stays in the catalogue even if you later delete your account, because other people's logs depend on it. Only the product data is shared. Your identity is not shown.
We may use aggregated, anonymised statistics, such as how often a barcode is scanned, to improve the app.
10. Our intellectual property
The Calzone name, logo, app, website and everything in them belong to us. You get a personal, non-transferable, revocable licence to use the Service as intended. Nothing else is granted.
11. Availability and changes
We work to keep the Service running, but we cannot promise it is never down. Features may be added, changed or removed. The AI features depend on a third-party provider and on a daily usage limit, so they are not guaranteed to be available at every moment. If we make a significant change to these terms we will tell you before it takes effect, and continuing to use the Service afterwards means you accept it. If you do not accept it, you can stop using the Service and cancel.
12. Ending the agreement
You can leave at any time. Delete your account in Settings, then Privacy, then Delete my account, and your data goes with it. Cancelling a subscription is separate and is done in the App Store or Google Play. We may end the agreement if you seriously breach these terms, or if we discontinue the Service, in which case we will give reasonable notice.
13. Disclaimers and liability
The Service is provided as it is. We do not warrant that it will be uninterrupted or that an estimate will be accurate.
We are liable for damage we cause intentionally or through negligence, as Polish law provides. We are not liable for indirect or consequential loss, for lost profits, or for decisions you make about your diet based on an estimate. Nothing here limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, and nothing here takes away the mandatory rights you have as a consumer.
14. App Store and Google Play terms
These terms are between you and us, not between you and Apple or Google. Apple and Google have no obligation to provide support for the app. If the app fails to work as promised, you may tell Apple, which may refund the purchase price, and beyond that refund Apple has no other obligation in respect of the app. We, not Apple, are responsible for the app, for any claim that it infringes intellectual property, and for handling any product liability or legal claim about it. You confirm that you are not in a country subject to a United States embargo and are not on a prohibited-parties list. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
15. Governing law and disputes
Polish law governs these terms. If you are a consumer, you also keep the protection of the mandatory rules of the country you live in, and you can bring a claim in the courts of your own country. Otherwise, the courts with jurisdiction over our registered seat in Poland decide any dispute. Before that, write to us, because most things are settled by email in a day. Polish consumers can also use the out-of-court routes offered by the Inspekcja Handlowa or a municipal consumer ombudsman.
